Moment of Wisdom GH TV: Reflections on Justice and Family Disputes in Ghana

The Ghanaian justice system continues to face public scrutiny, particularly in cases where family disputes escalate into criminal proceedings. One such case currently before the Circuit Court in Kwadaso, Kumasi, has drawn public attention due to its complex mix of family relations, financial transactions, and questions about fairness in the judicial process.

The case involves two siblings: Esther Aboagye, a resident of Berlin, Germany, and A. Aboagye, a resident of Kumasi, Ghana.

Background of the Case

According to available information, Esther Aboagye transferred an amount of GH₵70,000 to A. Aboagye. The money was allegedly intended to facilitate A. Aboagye’s travel to Germany, with assistance from their younger brother, popularly known as Junior.

However, events took an unexpected turn when Junior reportedly quarreled with Esther Aboagye. As a result, he allegedly failed to inform A. Aboagye of her interview date at the German Embassy. This development meant that A. Aboagye could not attend the interview, effectively halting the travel plans.

This situation reportedly angered Esther Aboagye, who subsequently demanded a refund of the GH₵70,000.

Dispute Over Refund

A. Aboagye is said to have refused to return the full amount, arguing that during Esther Aboagye’s early days in Germany—when she was struggling financially—their elder sister, Maame Abena, who resides in the United States, used to send money to Esther Aboagye for her upkeep.

This disagreement escalated, leading Ruth Aboagye, acting on behalf of Esther Aboagye, to lodge a complaint with the police. Following this, A. Aboagye was arrested and later granted bail.

Payments and Court Proceedings

According to A. Aboagye, an amount of GH₵30,000 was later handed over to Ruth Aboagye, on the instruction of Esther Aboagye. She claims the money was used to support Esther Aboagye’s building project in Ghana.

The case was subsequently referred to the Kwadaso Circuit Court in Kumasi. During proceedings, A. Aboagye, through the prosecutor ASP Asamba, informed the court that she had already paid GH₵5,000 and was making additional payments of GH₵500. She further indicated that Mr. Boakye had promised to assist her in settling the outstanding amount by March 2026.

Remand Decision

Despite these representations, His Honour Judge Jephthah Appau reportedly ordered that A. Aboagye reappear before the court on 29th December 2024, citing her failure to pay a substantial portion of the remaining GH₵35,000.

This decision has sparked controversy, especially following allegations that Ruth Aboagye reportedly told a third party that she paid money to influence the remand of A. Aboagye. At the time of this report, these allegations remain unproven and have not been confirmed by the court.
